Find your Oasis

1. CONTEST PERIOD

1.1 The “Find Your Oasis®” contest (the “Contest“) organized by A. Lassonde Inc. (the “Sponsor“) begins on _APRIL 18, 2024¬¬ at 11:00:00 a.m. (EST) AND ENDS ON OCTOBER 24, 2024 at 05:00:00 p.m. (S.N.T.) (the “Contest Period“).

2. ADMISSIBILITY

2.1 The Contest is open to residents of Canada. In order to be eligible to participate in the Contest, an entrant must (i) be an individual, (ii) be a legal resident of his/her province, and (iii) have reached the age of majority in his/her province of residence at the time of entry into the Contest.

2.2 Employees of the Sponsor and its partners, affiliates, advertising and promotional agencies and parties involved in the development, production and distribution of Contest-related materials, as well as all persons with whom such persons are domiciled and all members of their immediate families, are not eligible to participate in the Contest. For the purposes of this Regulation, “immediate family” includes the father, mother, brother(s), sister(s), child(ren), husband, wife or spouse of such a person, whether or not such persons are domiciled in the same place.

3. HOW TO PARTICIPATE

3.1 No purchase necessary. To enter, the entrant must register via the Contest tab at the following address: www.oasis.ca/en/find-your-oasis (the “Contest Site“), complete an online entry form and validate it as indicated (the “Entry Form“).

3.2 To complete the Entry Form, the participant must provide his/her first and last name, full email address and telephone number. All data entry fields on the Entry Form must be completed, unless it is indicated that the information is optional. Any Entry Form for which the mandatory information provided is incomplete or inaccurate may be declared ineligible for the Contest. The Sponsor reserves the right, in its sole discretion and at any time, to request proof of identity and/or eligibility to enter the Contest. A Contest entrant may only use one (1) email address to register from the Contest Site. Only one (1) Entry per entrant per day per email address for the duration of the Contest. The Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be in violation or attempted to violate the Contest Rules. Automatic entries are strictly prohibited, and any direct or indirect use of automatic devices will result in the immediate disqualification of the Entrant and his/her accomplices, and the Sponsor reserves all rights and remedies against the user of such automated devices and his/her accomplices.

4. WINNER SELECTION

4.1 The Grand Prize Winner

  (a) One (1) finalist for the Grand Prize (as defined below) (the “Grand Prize Finalist“) will be selected in a random drawing from among all eligible Entry Forms received in accordance with these Rules (the “Grand Prize Draw“).

  (b) The Grand Prize Draw will take place on October 30, 2024, at the offices of Produktions K (“ProdK”) 1744 William Street, Suite 108, Montreal, H3J 1R4 at 11:00:00 a.m. (EST). The odds of being selected for the Grand Prize depend on the number of eligible Entries received.

  (c) The Grand Prize Finalist will be notified by email within five (5) business days of the date he or she is selected as a Grand Prize Finalist. In the event that the Grand Prize Finalist does not return the phone call or respond to the email sent by ProdK within five (5) business days of the initial contact, the Grand Prize Finalist will be disqualified, and a second Grand Prize Finalist will be selected from among all remaining Entry Forms. In the event that ProdK is unable to notify the second Grand Prize Finalist within a reasonable time or if the second Grand Prize Finalist does not return the phone call or respond to the email sent by ProdK within five (5) business days, the second Grand Prize Finalist will be disqualified and the Sponsor will have the right, in its sole discretion, to cancel the awarding of the Grand Prize (as defined below).

  (d) ProdK will send the Grand Prize Finalist a release form (the “Release Form“) in which the Grand Prize Finalist acknowledges and confirms that these Rules have been complied with and that the Sponsor and any organization participating in the awarding of the Grand Prize or the Contest and their respective employees assume no liability for any damages, accident, loss or damage whatsoever related to this Contest, the Grand Prize, the use or awarding of the Grand Prize.

  (e) In order to be declared a Grand Prize winner (the “Grand Prize Winner“), the Grand Prize Finalist must correctly answer the mathematical skill-testing question without assistance of any kind (including mechanical assistance) and must sign and return the Release Form within five (5) days of ProdK submitting this Release Form to the Grand Prize Finalist as set out in these Rules. Otherwise, the Grand Prize will be deemed to have been forfeited by the Grand Prize Finalist and the Sponsor will have the right, in its sole discretion, to select an alternate Grand Prize Finalist in accordance with this Section 4.1 or cancel the Grand Prize award.

  (f) ProdK will contact the Grand Prize Winner within thirty (30) days of ProdK’s receipt of the Release Form duly completed and signed by the Grand Prize Winner, in order to make arrangements for the Getaway (as defined below).

  (g) The Grand Prize Winner is responsible for obtaining a reservation for accommodations from ProdK. Bookings for accommodation are subject to availability and restrictions set out in clause 5.1 below.

5. PRICE

5.1 Grand Prize

  (a) One (1) grand prize (the “Grand Prize“) will be awarded in this Contest. The Grand Prize consists of:

    (i) A four (4) day stay for four (4) people in Toffino, British Columbia (the “Getaway“) including:

    (ii) Four (4) nights’ accommodation in a three star hotell (approximate retail value (“ARV“) of two thousand (CAD$ 2000.00) dollars. Maximum occupancy of four (4) people (four (4) adults);

    (iii) Four (4) round-trip economy class airfare tickets ;

  (iv) Round-trip airport to the hotel transfer ARV of three hundred (CAD$ 300.00) dollars ;

  (v) An Introductory surf course five hundred (CAD$ 500.00) dollars;and

  (vi) A $1,000.00 (CAD$1,000.00) prepaid card for meals and personal expenses.

(b) The total ARV of the Grand Prize is seven thousand five hundred (CAD$ 7,500.00) dollars (excluding applicable taxes).

(c) The Grand Prize Winner must select a maximum of three (3) guests of the age of majority (collectively, the “Guest“) at his/her discretion. The Guest must complete and sign a Release Form in which the Guest confirms that these Rules have been complied with and that the Sponsor and any other organization involved in the awarding of the Grand Prize or the Contest, as well as their respective employees, assume no responsibility for any injury, accident, loss or misfortune related to the Contest, the Grand Prize or the Grand Prize award.

  (d) The Getaway must take place within twelve (12) months of the end of the Contest Period. The Grand Prize Winner is responsible for making reservations with ProdK. Accommodation is subject to availability and the terms and conditions of the accommodation provider. The Grand Prize Winner and his/her Guest must be available to travel on the dates set out in these Rules. Once bookings for accommodation have been made, they cannot be changed. If the Grand Prize Winner or his/her Guest is unable to travel on the dates set out in these Rules, the Grand Prize will be awarded to an alternate entrant in the manner set out in Section 4.1 or cancelled altogether at the sole discretion of the Sponsor. The Grand Prize Winner and his/her Guest must comply with all applicable laws and rules (including the rules of the suppliers when using the Grand Prize.

(e) The following expenses are excluded from the Grand Prize and are the sole responsibility of the Grand Prize Winner and his/her Guest:

    (i) Transportation between the Grand Prize Winner’s and Guest’s place of residence and their local airport;

    (ii) Any accommodations other than those provided for in the Grand Prize description;

    (iii) Meals, snacks or food items;

    (iv) All other expenses not specifically included in the Grand Prize description, including, but not limited to, personal items, travel insurance, service charges, and gratuities, telephone, fax, cable, cleaning, room service and valet fees.

5.2 Secondary Prizes

  (a) Five (5) Secondary Prizes, each consisting of:

    (i) A year’s supply of Oasis® juice with a maximum ARV of three hundred and fifty (CAD$ 350.00) dollars; and

    (ii) A microfiber beach towel with an ARV of twenty-five (CAD$ 25.00) dollars;

  (b) The total ARV of each Secondary Prize is three hundred and seventy five (CAD$375.00) dollars (excluding applicable taxes).

5.3 The draw for the Secondary Prizes will be conducted in the same manner as identified in Section 4.1 and the winners of the Secondary Prizes will be notified as provided in this Section. They will also be subject to the conditions set out in paragraphs 4.1(e) and (d).

5.4 The Secondary Prizes will be couriered to the winners of the Secondary Prizes within thirty (30) days of ProdK’s receipt of the Release Form duly completed and signed by the winners of the Secondary Prizes.

6. PERSONAL INFORMATION

6.1 By entering the Contest, each entrant consents to the collection, use and disclosure by the Sponsor or its authorized agents of his/her personal information provided through the Entry Form for the purposes of administering the Contest and delivering the Prizes. Once submitted, Entry Forms become the property of the Sponsor and will not be returned.

6.2 Personal information may be disclosed to third parties retained by the Sponsor for storage, management or other similar services, subject to applicable privacy laws and its internal privacy policy. The file containing the personal information will be maintained at the offices of the Sponsor or its service providers or on their servers and will be accessed by employees who require it in order to perform their duties. To the extent permitted by law, individuals may request access to the file containing their personal information and the correction of such information by contacting the Sponsor c/o A. Lassonde Inc. Marketing Department, 170 5th Avenue, Rougemont, Quebec J0H 1M0.

6.3 By accepting a Prize, the Winner grants the Sponsor the right to produce, reproduce, publish, broadcast, transmit by telecommunication, exhibit, distribute, adapt, use or reuse, in any way in connection with the Contest, its promotion or operation, his/her name, address (city, province), voice, statements, image, photographs or other representations and recordings for publicity purposes in any and all media and formats, including, but not limited to, the Internet, without further notice or compensation, and any Winner may be required to sign a document to that effect.

7. ERRORS

7.1 The Sponsor reserves the right to void Entry Forms that contain or contain errors. Entries that have been tampered with, altered, altered, falsified, reproduced or illegally obtained will not be eligible. Without limiting the scope of the exemption provided for in section 9.1, for greater certainty, the Sponsor and any other organization involved in the administration of the Contest or the awarding of the Prizes, and their respective representatives and employees, assume no responsibility for: (i) illegible, incomplete, altered, lost or delivered late or to the wrong address, such Entry Forms shall be deemed void, (ii) any inaccurate or inaccurate information from users of the Contest Site or the equipment or programs used in connection with the Contest, or from technical or human error that may occur in the processing of the Entry Forms; (iii) theft, destruction, unauthorized access to, or alteration of, the Entry Forms; (iv) technical difficulties or problems with telephone networks or lines, computer on-line systems, servers or providers, computer hardware and software, viruses or bugs; (v) the inability of the Sponsor for any reason, including, without limitation, traffic congestion on the Internet and/or at any website, to receive or send any message or e-mail; (vi) damage to entrant’s or any other person’s computer system or device on account of participating in, or downloading or uploading materials in connection with this Contest. The use of automated systems is prohibited.

8. RIGHT TO CANCEL, SUSPEND OR MODIFY

8.1 By participating in this Contest, each entrant agrees to be bound by these Rules, which are available on the Contest Site throughout the Contest Period. The Sponsor reserves the right to amend these Rules without notice.

8.2 Subject to the foregoing, the Sponsor may make changes to or terminate the Contest in whole or in part at any time if, in its sole discretion, it determines that, for any reason, the Contest is not running as planned, including, without limitation, due to fraudulent manipulation, destruction, loss or theft of the Entry Forms or any other defect that could compromise the fairness or integrity of the Contest.

9. TERMS & CONDITIONS

9.1 By entering or attempting to enter the Contest, each entrant or potential entrant agrees to:

  (a) forever release, discharge and hold harmless the Sponsor and its directors, officers, employees, shareholders, agents or other representatives, its parent company and its affiliates from any and all claims, actions, damages, demands, means of action, causes of action, suits or liabilities of any kind whatsoever arising out of or in connection with participation in the Contest or attempted participation in the Contest, compliance or non-compliance with these Rules, acceptance, possession, use or abuse of a Prize or any activity related to a Prize, including the Getaway; and
  (b) fully indemnify the Sponsor and its directors, officers, employees, parent companies, subsidiaries, partners, sponsors and agents for any and all claims by third parties related to this Contest and any violation of these Rules by the entrant or Guest or any activity related to a Prize, including the Getaway, without limitation.

9.2 NO COMMUNICATION OR CORRESPONDENCE WILL BE ENTERED INTO WITH ENTRANTS, EXCEPT WITH ENTRANTS SELECTED AS POTENTIAL PRIZE WINNERS.

9.3 The Sponsor reserves the right, in its sole discretion, to disqualify from the Contest and any other contest or future promotion offered by the Sponsor any entrant who fails to comply with these Rules. The Regulations are available on the www.oasis.ca/en/find-your-oasis.

9.4 Each Prize must be accepted as awarded, without substitution in cash or otherwise, except as agreed to by the Sponsor. The Sponsor reserves the right to substitute a Prize of equivalent value if any Prize cannot be awarded as contemplated by these Rules. Any portion of a Prize that is not accepted by the applicable Winner will be deemed to have been forfeited. The Sponsor makes no warranty, express or implied, as to the safety, appearance or performance of any Prize or Prize-related activity. By accepting the Prize, the Winner acknowledges that the only warranties applicable to any aspect of the Prize, if any, are the warranties provided by the Prize supplier to the Sponsor that are transferable and/or the manufacturer’s warranties. The Winner has no recourse against the Sponsor with respect to any warranty related to the Prize under any circumstances. In the event that the Grand Prize Winner fails to use all or any part of the Grand Prize Elements for any reason, such person will not be financially compensated and such elements will become void. The Sponsor will not be responsible for any event leading to the cancellation of the Grand Prize or for events beyond its control that result in the Grand Prize or any portion of the Grand Prize not being awarded.

9.5 In the event of a dispute related to the person who validated an Online Entry Form, the same Entry Form will be deemed to have been validated by the authorized account holder of the email address submitted at the time the Entry Form was validated. For purposes of these Rules, “Authorized Account Holder ” means the natural person who has been assigned an email address by an Internet access provider, Internet service provider, or other organization responsible for assigning email addresses for the domain linked to the email address in question. The selected entrant may be required by the Sponsor to provide proof that he/she is the Authorized Account Holder of the email address provided on the Selected Entry Form.

9.6 The Sponsor reserves the right, in its sole discretion, to disqualify from this Contest and any future contest or promotion held by the Sponsor any person who is guilty or suspected of tampering with the processing of the Entry Forms, the operation of the Contest or the Contest Site, violating these Rules or acting in a manner that is harmful or intending to annoy, tormenting, threatening or harassing another person. AN ENTRANT OR ANY OTHER PERSON WHO WILFULLY ATTEMPTS TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS GUILTY OF A CRIMINAL OFFENCE OR A MISDEMEANOR AND THE SPONSOR RESERVES THE RIGHT TO SEEK ANY DAMAGES FROM SUCH PERSON AS IT IS ENTITLED TO RECOVER BY LAW.

9.7 In the event of any discrepancy between the English and French versions of these Rules, the English version shall prevail.

10. LIMITATION OF LIABILITY

10.1 The Sponsor assumes no responsibility for lost, delayed, destroyed or misdirected entries, communications, responses, declaration forms and releases, or for any technical malfunctions, including but not limited to computer, software, telecommunications, telephone or online connections.

10.2 The Sponsor assumes no responsibility for any inaccurate or inaccurate information, whether caused by users or by any equipment or programming associated with or utilized in the Contest or by any human or technical error that may occur in the administration of the Contest.

10.3 The Sponsor reserves the right, subject to the consent of the Régie des alcools, des courses et des jeux (the “Régie”), to cancel, suspend or modify the Contest if a virus, bug or other computer problem, unauthorized human intervention or any other cause beyond the control of the Sponsor corrupts or affects the administration, the security, fairness, integrity or proper conduct of this Contest.

11. RELEASE / PRIVACY / USE OF INFORMATION PROVIDED BY THE PARTICIPANT

11.1 By participating in this Contest, each entrant consents to the collection, use and disclosure by the Sponsor or its authorized agents of his/her personal information provided through the entry form for the purposes of administering this Contest and awarding the prize. Once submitted, entries become the property of the Sponsor and will not be returned.

11.2 Personal information may be disclosed to third parties retained by the Sponsor for storage, management or other similar services, subject to applicable privacy laws and the Sponsor’s internal privacy policy. The personal information file will be maintained at the offices of the Sponsor or its service providers or on their servers and will be accessible to employees who require it in order to perform their duties. To the extent permitted by law, individuals may request access to the record containing their personal information and the correction of such information by contacting the Sponsor.

11.3 By accepting a prize, the winner grants the Sponsor the right to produce, reproduce, publish, broadcast, telecommunicate, exhibit, distribute, adapt, use or reuse, in any way in connection with the Contest, its promotion or operation, his/her name, address (city, province), voice, statements, image, photographs or other representations and recordings for publicity purposes in any and all media and formats, including, but not limited to, the Internet, without further notice or compensation, and any winner will be required to sign a document to that effect.

12. INTELLECTUAL PROPERTY

12.1 All intellectual property rights in all promotional materials and the Contest Site are owned by the Sponsor or its affiliates or licensors. All rights reserved. Unauthorized copying or use of copyrighted or intellectual property material without the express written consent of its owner or holder is prohibited. All trademarks are the property of their respective owners.

13. MEDIA

13.1 The Contest is not administered or sponsored by Facebook, Instagram, Pinterest, Youtube, TikTok or any other media (the “Media”). The entrant is providing his/her personal information to the Sponsor and not to the Media and is not responsible in any way for any matter relating to this Contest.

14. GOVERNING LAW

14.1 These are the Official Rules of the Contest. This Contest is subject to all applicable federal, provincial and municipal laws and regulations. The Rules of this Contest are subject to change without notice, including to comply with all applicable federal, provincial and municipal laws or the policies of any entity having jurisdiction over the Sponsor.

15. RÉGIE DES ALCOOLS, DES COURSES ET DES JEUX

15.1 Any litigation respecting the conduct or organization of this contest may be submitted to the board for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

16. WINNERS’ LIST

16.1 Within thirty (30) days of October 30, 2024, the Sponsor will post the name of each Winner on the Contest Site for a period of at least thirty (30) days.
